Appalachian Insulation Supply, Inc., and its affiliated entities (hereinafter, collectively, “AIS“, “we“, “us” or “our“) provides the following information concerning its collection, storage and use of personal data (“Personal Data” or “Personal Information”) provided by visitors and customers at www.ais1.us (the “Site”).

AIS respects the privacy of all persons who visit or use the Site (“you” or “Customers” or “Data Subjects”).  AIS also protects the privacy of its employees, vendors, service providers, partners and others who come into contact with the Site. The Site is intended for use by Customers and visitors located in the United States of America and the principal aim of this Privacy Policy and Privacy Notice (this “Privacy Policy”) is compliance with the privacy and data protection laws of the United States of America, including, the California Consumer Privacy Act of 2016 (“CCPA”), and the California Consumer Privacy Rights Act of 2018 (“CPRA”) and, more recently, the Colorado Privacy Act (“CPA”) , the Connecticut Act Concerning Personal Data Privacy and Online Monitoring (“CTDPA”), the Utah Consumer Privacy Act (“UCPA”) and the Virginia Consumer Data Protection Act (“VCDPA”). Many other states are considering similar laws and AIS will comply with such laws as they become effective.

Other countries also have enacted laws to protect the Personal Data and Personal Information of their citizens that are similar to those in the United States, but AIS does not track and may not comply with all such requirements.

This Privacy Policy explains the types of Personal Data that we may collect from you or that you may provide when you visit the Site. Other websites offered by AIS’s suppliers and business partners – even if accessed through the Site – are subject to their own privacy and data protection policies and are not subject to this Privacy Policy.

Please read the following carefully to understand our practices regarding your Personal Data and how we will treat it. AIS intends to be transparent about its practices regarding the information it collects, stores, uses, maintains and processes and describe its current practices in this Privacy Policy.

WHAT PERSONAL DATA DO WE COLLECT?

Summary: AIS collects Personal Data about you from your transactions with us, like using the Site, visiting our facilities, calling our call center, making a purchase or entering into an agreement with us.

 

AIS may also collect data that is non-identifiable and anonymous information (“Non-Personal Data”) the use of which is not subject to this Privacy Policy.

 

AIS also collects several categories of Personal Data.  Personal Data we collect consists of any Personal Data provided by you, or by an organization you represent or are associated with, or through your use of the Site. This may include your first and last names, email address, phone numbers, picture, postal address, birthdate, gender, credit card and other such payment and billing details, billing address, login credentials, your account username and password and usage details, and similar information for your organization, together with other information you may choose to provide to AIS.

 

Additionally, we may obtain location data that is Personal Data related to the geographic location of your computer, mobile device or other digital device on which the Site are accessed.

AIS may also collect Personal Information consisting of the email addresses of people who communicate with AIS via email or other social media platforms or create accounts and login credentials. AIS may also collect Personal Information of people who call our call center, including Personal Information that enables us to identify the caller and follow-up on the call, as well as any information that is provided during the course of the call, including a voice recording of the call.

If you register using the Site or submit requests for support or information using the Site, AIS will collect details, including Personal Information consisting of your name, company name, phone number and personal or company email you provided, address, birthdate and other such information. AIS may use this information to offer AIS’s services and support (“Services”) and will share this data across AIS affiliates to optimize the Services offered on the Site and improve AIS.

You do not have any legal obligation to provide any Personal Information to AIS; however, we require certain information in order to perform Services requested on the Site, such as the sale or purchase of products (“Products”) or to provide a variety of other Services. If you choose not to provide us with certain information, we may not be able to provide you with some or all of the Services or fulfill your order for Products.

You may create an AIS account on the Site. In some cases, you may be able to access Services through login credentials of a designated third-party website or service (each a “Third-Party Account”), including but not limited to Google, LinkedIn, Facebook or Twitter. Doing so will enable you to link your AIS account and your Third-Party Account. If you choose this option, then you will be required to approve the connection as well as the provision of information (which may include Personal Information, such as your profile picture, gender, birthdate, headline, summary, friends’ lists, previous positions and organizations), that we may obtain from your Third-Party Account. Any Personal Data or other data submitted to any Third-Party Account, even on and through the Site, is managed directly by such third party and is not the responsibility of AIS.

 

Additional third-party services may be accessed through the Site. AIS is not responsible for any Personal Data or other data submitted to, or otherwise processed through, such Third-Party Account. For example, where a credit card purchase is made on the Site, customers may be redirected to a third-party service provider to process payment, and all aspects of that service and payment, including also any Personal Data submitted in connection with that service, are within the responsibility of the third-party service provider, and not of AIS.

AIS also collects contact and related Personal Data about potential customers via the Site, at events, through social media (such as Facebook and LinkedIn), when it is given for that purpose to our employees, and through other such sources. This Personal Data is used to market our Products and Services and to keep our followers up to date on AIS.

 

HOW DO WE COLLECT YOUR PERSONAL DATA?

Summary: AIS collects Personal Data through your use of the Site, through data you or others provide when you prepare and enter into a transaction with us, or otherwise engage with us, or contact us.

 

In other words, when you are using the Site, we are aware of it and may gather, collect and record the information relating to such usage, either independently or through the help of third-party Services as detailed below. This may include technical information and behavioral information such as the user’s Internet protocol (IP) address used to connect your computer to the Internet, your uniform resource locators (URL), operating system, type of browser, browser plug-in types and versions, screen resolution, Flash version, time zone setting, the user’s ‘clickstream’ on the Site, the period of time the user visited the Site, methods used to browse away from a page, and any phone number used to call our customer service number. We likewise may place “Cookies” on your browsing devices (see ‘How Do We Use Site and Application Data Collection and Cookies’ section below).

We collect Personal Data required to provide Services when you register interest, place an order for Products and/or open an account. In addition, we collect your Personal Data, when you provide us such information by entering it manually or automatically, or through your use of the Site, facilities, Services and applications, or in connection with visits to our offices and facilities, in the course of preparing a contract, or otherwise in engaging with us. We may also collect Personal Data through our CCTV recordings at our physical locations, our call center facilities, and through our card reader and visitor registration systems, which automatically collect information about your presence in our facilities.

FOR WHAT PURPOSES DO WE COLLECT YOUR PERSONAL DATA?

Summary: AIS uses Personal Data for a range of lawful purposes, such as: staying in touch, improving our Services, meeting our obligations, providing support.

 

We will use Personal Data to provide and improve our Services and Products and meet our contractual, ethical, and legal obligations, including, but not limited to, the following:

  • to enable us to meet our legal, contractual, ethical and business obligations as an employer and a potential employer for our employees and job applicants;
  • carrying out our obligations arising from any contracts entered into between you or your employer or organization and AIS and/or any contracts entered into with AIS and to provide you with the information, Products and Services that you request from AIS;
  • administering your account with AIS including to identify and authenticate you;
  • verifying and carry out financial transactions in relation to payments you make in connection with the Products;
  • notifying you about changes to our Services and Products;
  • contacting you for the purpose of providing you with technical assistance and other related information about the Products;
  • replying to your queries, troubleshooting problems, detecting and protecting against error, fraud or other criminal activity;
  • contacting you to give you commercial and marketing information about events or promotions or additional Services and Products offered by AIS, including in other locations;
  • soliciting feedback in connection with your use of the Services and the Products purchased;
  • tracking use of AIS facilities and Services to enable us to optimize them;
  • contacting you to inform you of additional Services and Products which may be of interest to you;
  • compliance and audit purposes, such as meeting our reporting obligations in our various jurisdictions, and for crime prevention and prosecution in so far as it relates to our staff, customers, facilities etc.;
  • if necessary, we will use Personal Data to enforce our terms, policies and legal agreements, to comply with court orders and warrants and assist law enforcement agencies as required by law, to collect debts, to prevent fraud, infringements, identity thefts and any other service misuse, and to take any action in any legal dispute and proceeding;
  • for security purposes and to identify and authenticate your access to the parts of the facilities.

 

WITH WHICH THIRD PARTIES MAY WE SHARE YOUR PERSONAL DATA?

Summary: AIS shares data, including Personal Data, with its affiliates and with our suppliers, vendors and service providers.

 

We may share Personal Data with:

— Affiliates, suppliers, vendors and service providers (collectively, the “Group”): This includes any member of the Group in the United States of America or elsewhere.

 

— Third Parties. We share Personal Data with third parties in a variety of circumstances. We take steps to ensure that these third parties use your information only to the extent necessary to perform their functions, that they provide the same level of protection of your rights as we do, and to have a contract in place with them to govern their processing on our behalf. These third parties may include business partners, suppliers, affiliates, agents and/or sub-contractors for the performance of any contract we enter into with you. They assist us in providing the Products we offer, processing transactions, fulfilling requests for information, receiving and sending communications, analyzing data, providing IT and other support services or in other tasks, from time to time. These third parties may also include analytics and search engine providers that assist us in the improvement and optimization of the Site, our application, and our marketing.

We periodically add and remove third-party providers. At present our third-party providers to whom we may transfer Personal Data include the following: website analytics; computing providers; customer ticketing and support; on-site and cloud-based database services; vendor and IT service and support providers; distributors, shipping and logistics companies; our lawyers and accountants; and other standard business services.

In addition, we may disclose your Personal Data to third parties if some or all of AIS’ equity or its assets are acquired by a third party including by way of a merger, share acquisition, bulk asset purchase, or any similar transaction, in which case Personal Data may be one of the transferred assets and is required by the acquiring party to provide Services to you.

We may transfer Personal Data to third parties if we are under a duty to disclose or share your Personal Data in order to comply with any legal or audit or compliance obligation, in the course of any legal or regulatory proceeding or investigation, or in order to enforce or apply our terms and other agreements with you or with a third party; or to assert or protect the rights, property, or safety of AIS, our customers, or others. This includes exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction and to prevent cybercrime.

For avoidance of doubt, AIS may transfer and disclose Non-Personal Data to third parties at its own discretion consistent with applicable laws.

WHERE DO WE STORE YOUR PERSONAL DATA?

Summary: AIS stores your Personal Data securely at its facilities or with reliable service providers. 

We may keep Personal Data in servers and systems owned or controlled by AIS in our various sites, or processed by third parties on behalf of AIS, by reputable cloud-service providers and other such service providers, including in AIS subsidiary locations in the United States of America. Personal Data is also stored in our onsite and offsite backups.

HOW LONG DO WE RETAIN YOUR PERSONAL DATA?

Summary: AIS does not retain your Personal Data once it no longer serves the purposes for which we collected it.

AIS will retain Personal Data it processes only for as long as required in its reasonable determination, to provide the Services or Products and as necessary to comply with our legal and other obligations, to resolve disputes and to enforce agreements, and generally to meet the purposes for which it was collected. We will also retain Personal Data to meet any audit, compliance and business best-practices. The retention period will vary based on the form and purpose of the data, and the jurisdictions involved.

Personal Data that is no longer retained may be anonymized or deleted. Likewise, some metadata and statistical information concerning the use of our Services are not subject to the deletion procedures in this Privacy Policy and may be retained by AIS. We will not be able to identify you from this data. Some data may also be retained on our third-party service providers’ servers until deleted in accordance with their privacy policy and their retention policy. Even when we delete data, some Personal Data may remain in our backups and various systems until they are cycled out or until it is feasible to remove that Personal Data.

HOW DO WE USE SITE AND APPLICATION DATA COLLECTION AND COOKIES?

Summary: The Site places and tracks cookies, and collects some Personal Data, such as IP addresses. You can control this and stop it through your web browser.

Most browsers will allow you to erase cookies from your computer’s hard drive, block acceptance of cookies, or receive a warning before a cookie is stored. However, if you block or erase cookies your online experience on the Site will be limited.

Disabling cookies: The effect of disabling cookies depends on which cookies you disable but, in general, the Site and some Services delivered through it may not operate properly, may not recognize your device, may not remember your preferences and so on if cookies are disabled or removed. However, allowing or disabling cookies is your choice and in your control. WHAT ARE OUR SECURITY AND STORAGE OF INFORMATION PRACTICES?

Summary: We store Personal Data securely, but there is no such thing as perfect data security.

 

AIS takes care in implementing, enforcing and maintaining the security of the Personal Data we process. AIS implements, enforces and maintains security measures, technologies and policies to prevent the unauthorized or accidental access to or destruction, loss, modification, use or disclosure of Personal Data. We likewise take steps to monitor compliance of such security measures, technologies, and policies on an ongoing basis. Where we deem it necessary, in light of the nature of the data in question and the risks to Data Subjects, we may encrypt data. As noted above, we also endeavor to delete Personal Data that no longer serves its intended purpose. Likewise, we take industry standard steps in an effort to ensure that the Site and the Personal Information in our possession are safe.

Note, however, that no data security measures are perfect or impenetrable, and we cannot guarantee that unauthorized access, leaks, viruses and other data security breaches will never occur or affect the Site.

Within AIS, we endeavor to limit access to Personal Data to those of our personnel who: (i) require access in order for AIS to fulfil its obligations under law and contract, and under this Privacy Policy, and (ii) have been appropriately and periodically trained on the requirements applicable to the processing, care and handling of the Personal Data, and (iii) are under confidentiality obligations as may be required under applicable law.

AIS will act in accordance with its policies and with applicable law to promptly notify, where so required, the relevant authorities and Data Subjects in the event that any Personal Data processed by AIS is lost, stolen, or where there has been any unauthorized access to it, all in accordance with applicable law and on the instructions of qualified authority.

WHAT ADDITIONAL RIGHTS DO CALIFORNIA RESIDENTS HAVE UNDER THE CCPA & CPRA?

Summary: If you are a California resident, you may be able to “opt out” of the “sale” or “sharing” of your “Personal Information” to “third parties” (as those terms are defined in the CCPA and CPRA).

AIS does not sell your Personal Information in the normal sense of the word. AIS does share your Personal Information with Google in exchange for analytics information. CCPA may permit you to request in writing a list of the categories of personally identifiable information disclosed by AIS to third parties, and the identifies of those third parties, during the preceding year, for the third parties’ direct marketing purposes, and to obtain such information free of charge up to twice in a 12-month period.

CCPA also may grant you the right to request disclosure from AIS of the following:

  1. The categories of Personal Information AIS has collected about you;
  2. The categories of sources from which the Personal Information is collected;
  3. The business or commercial purpose for collecting Personal Information;
  4. The categories of third parties with whom the business shares Personal Information; and
  5. The specific pieces of Personal Information AIS has collected about you.

In addition, you may have various rights in relation to your Personal Information:

  • a right to request that we rectify your Personal Information if our records are inaccurate;
  • a right to request that we delete your Personal Information;
  • a right that we provide you with your Personal Information in a readily accessible format;
  • a right to request that we limit the use of your sensitive Personal Information.

There is no cost to making a request to exercise any of your rights. However, AIS may require that you verify your identity.

Where a California resident consumer has exercised any of the consumer’s rights, AIS will not discriminate against the consumer for exercising such right, including, but not limited to, by not doing any of the following:

  1. Denying goods or services to the consumer.
  2. Charging different prices or rates for goods or services, including through the use of discounts or other benefits or imposing penalties.
  3. Providing a different level or quality of goods or services to the consumer.
  4. Suggesting that the consumer will receive a different price or rate for goods or Services or a different level or quality of goods or services.

California’s “Shine the Light” Law. This law permits users of the Site that are California residents to request certain information regarding our disclosure of Personal Information to third parties for their direct marketing purposes. Summary: The Privacy Laws of these states, like the CCPA and CPRA in California, may allow you to “opt out” of the “sale” or “sharing” of your “Personal Information” to “third parties and to correct or delete your Personal Information without risking discrimination for doing so. Minors. We do not knowingly collect or solicit information or data from children under the age of 16 or knowingly allow children under the age of 16 to register for AIS Services. If you are under the age of 16, do not register or attempt to register for any of AIS service or send any information about yourself to us. If we learn that we have collected or have been sent Personal Data or from a child under the age of 16, we will delete that Personal Data as soon as reasonably practicable without any liability to AIS.
